Candidate Declaration Guidelines
Candidates for different positions in the institutions of the justice system
1.Subjects obliged to declare their property and private interests:
a) Candidates that express interest in vacant positions of the Constitutional Court, according to the legislation that regulates the governance of the justice system;
b) Candidates that express interest in the High Inspectorate of Justice, as well as non magistrate candidates interested in the inspector position at the High Inspectorate of Justice Office, according to the legislation that regulates the governance of the justice system;
c) Candidates for admission to the initial formation of the School of Magistrates, as well as graduates that apply for magistrate appointment, according to the legislation that regulates the status of judges and prosecutors;
d) Judge and judicial civil servant candidates in the in special courts against corruption and organized of crime, as well as their relatives, according to the legislation that regulates the organisation and function of the institutions in fighting corruption and organized crime;
e) Prosecutor, investigation officers, administrative personnel of the Prosecutor, National bureau of investigation, candidates as well as their relatives, according to the legislation that regulates the organisation and function of the institutions in fighting corruption and organized crime;
f) Candidates, that, according to the legislation that regulates the status of judges and prosecutors, ask for promotion in more specialized levels;
g) Member of the High Court candidates from the ranks of prominent jurists, according to the legislation that regulates the status of judges and prosecutors;
h) Court president, or other Prosecutor Office candidates, according to the legislation that regulates the status of judges and prosecutors;
i) Every other person that has the obligation to declare before their nomination, according to the legislation in power.
2. Candidates of the positions specified at point 1, of this article, that carry the obligation to declare their private interests, according to article 3, of this law, are subject to full control of their property. If during the 180 day period before their request submission, the candidate is controlled by the High Inspectorate of Declaration and Audit of Assets and Conflict of Interests and the result of this control is in his favor, then the control is considered as complete.
3. The High Inspectorate performs full control for the verification of the authenticity and accuracy of the details contained in the declaration of the individuals specified in point 1 of this article, within 2 months from the day of the submission of the declaration, expect it is otherwise provided by law. Upon completion of the verification, the General Inspector immediately sends the report to the relevant institutions.
